On a recent 1.3 million dollar property that we listed, the seller was told that mineral rights was conveyed to him when he bought the property.  In the listing we communicated that the property came with both surface rights and mineral rights.  Tulsa Oklahoma has a deep oil patch heritage and these kind of things can break contracts.  Halfway through the escrow period, on a very large transaction, it was revealed that the prior title company wrote the wrong kind of deed to convey the property to my seller.  The result was that the prior owners still owned all rights to the property even though lots of discussions had ensued saying the opposite was true.

This could have been a problem as the prior owners could have simply refused to follow through on the verbal agreement.  What the prior owners did not know was that this entire deal hinged on those mineral rights conveying.  I mark this as one of the biggest obscure wins that most will overlook.  For a couple of weeks, through careful navigation and negotiation, I was able to get three heirs of the prior owners estate to come to the table and sign over the mineral rights to my seller.  The 1.3 million dollar property went to closing with little fanfare and all parties were very happy.  I will mark that careful negotiation as one of the most successful in my career, even having successfully navigated thousands of contracts in my 29 years of business.
